Whose signature is needed
In most states, a title that lists owners joined by "and" needs every owner's signature. A title that uses "or" may let one owner sign alone. The wording on your title matters, so check it before you call.
Owners in different places
Owners do not need to be together. We can send forms to each owner, and many states accept signatures on separate documents.
Divorce and separation
If the boat was awarded to one person in a divorce, the decree may let that person sign alone. Keep a copy of the relevant page ready.
Reading the title
Look at how the owners are listed. "And" usually means every owner signs. "Or" often means any one owner can sign. "And/or" varies by state. If you are unsure, send us a photo of the owner section and we will tell you what we think your state requires.
Business and club ownership
Boats titled to a business, club, or partnership are signed by an authorized officer or partner. The organization receives the tax paperwork.
When one owner cannot be reached
We cannot accept a boat without every required signature. If a co-owner cannot be found, talk with an attorney about your state's options before contacting us.
Questions
How is the deduction split between two owners?
Generally by each owner's share. Each owner should talk with their own tax advisor.
One owner has passed away. Who signs?
It depends on how the title is worded and your state's rules. A death certificate may be enough if the title was joint with right of survivorship.
My business partner will not respond. Can I donate the boat anyway?
Not without their signature, if the title requires it. We cannot accept a boat unless all required owners have agreed.
Can two owners sign on different days?
Yes. Signatures do not need to happen together.
Who receives the Form 1098-C?
We issue it to the donors named on the donation, and we can discuss how co-owners want it handled.
